West Virginia 1986, my Corrections consulting experience started with my first consulting assignment contract with the West Virginia Secretary of the Department of Corrections, as to conditions of confinement in their maximum security prison at Moundsville, W.V A serious inmate riot had taken place which included the taking of staff hostages and major damage to the facility by rioter’s. My duties included an assessment of the causes of the incident and development of preventative measures to avoid further incidents of this nature. Several operational deficiencies including but not limited to: training deficiencies of staff, security staff deployment and staffing deficiencies, physical plant design issues and adequate use of available resources, classification of inmates and their assignments, lack of experience by key administrative staff, lack of Hostage/negotiations training of staff and need for resources (Hostage/Negotiations training was initiated through-out the department beginning at the Moundsville Prison. A staff exchange project was developed allowing key Moundsville Prison staff to visit San Quentin which was comparable in physical plant and a maximum custody mission. A significant number of prison policies and operations changes resulted to bring then Prison into national prison guideelines compliance.
National Institute of Corrections, Federal Bureau of Prisons Short Term Grants 1989-1998. I was successful in receiving grant support from the National Institute of Corrections for several projects from 1989 to 1998, as outlined below:
The study of policies, practices, conditions of confinement, methods of Execution and the housing of Death Row inmates in several States (Texas, Georgia, Florida) with large populations of Condemned inmates as compared to the California’s Death Row at San Quentin State Prison and its need for immediate planning decisions as we faced a Death Row population growth of 2.5 per month. As a result of this study under written by the NIC short term options as recommended were accepted as new policy.
The study of methods of Execution in the State of Texas by Lethal Injection, Electric Chair in Florida resulted in the State of California rewriting its laws to permit the choice by inmates of method their of execution by lethal gas or lethal injection.
The training of staff for their participation as an Execution Team in the State of Maryland for the states first execution in 35 years. Additionally the following activities resulted; the remodeling and repair of the Maryland State Prison’s Gas Chamber, training of staff for the handling of media prior to and during the execution process and post execution prison operation.
Guest instructor on several occasions at the NIC Training Facilities in Longmont, Colorado and guest speaker at American Correctional Association (ACA) conferences in the following subject operations of large Security Housing Units (SHU), inmate Gang intelligence, identification and validation, classification and housing of Gang members/Associates and Disruptive Groups, selection and training of staff for high stress level assignments, handling of the Media of high interest level incidents.
The study of the evolution of the “Boot-Camp” phenomena in the United States and how the experiment could be made more effective. The result of the planned participation of the staff of the Santa Clara County Department of Corrections resulted in the complete reinventing of an existing Female prisoner “Boot-Camp” into a co-ed “Boot-Camp” program with emphasis on academic achievements, release planning, job interview and successful job hunting skills development, substance abuse prevention training, anger management skills, healthful living reconditioning. A major component of the new “Boot-Camp” program was an after custody release center component where the client interacted with his/her caseworker, Probation/Parole Officer, was monitored for substance abuse relapse and received any additional identified assistance to increase the offenders chances to avoid re-arrest and criminal conviction. The program received the support of the Santa Clara County Board of Supervisor’s and funding.Prison up to standards and to provide a safe and humane operation beneficial to both staff and inmates.
Assisted the Arizona Department of Corrections and the States Attorney Generals Office in their evaluation and development of a mental health procedural policy manual; as a result of litigation of the Departments Management Security Unit (MSU, a maximum custody state of the art Security Housing Unit, located in the Florence, AZ Correctional Complex). The issue involved the use of “Four Point Restraint” of mentally ill inmates experiencing psychotic episodes as a result of the deprivation of human contact and stimulation brought about by the nature of the security methods of confinement at the MSU Unit and the need for mental health professional resources as part of the MSU operations. The procedural policy developed and the agreement to provide adequate and immediate crisis intervention by professional mental health staff ended the litigation (Consent Decree).
Assisted the Texas Department of Corrections and the Texas State Attorney General’s Office in resolution of a Federal Consent Decree in re: Ruiz which was as a result of a successful Civil Law Suit filed against the Texas-DOC; over the long standing practices of the T-Texas-DOC in the use of a generations old “Con-Boss” system of inmate management, and the double cell segregation practices of Texas-DOC. The assistance I provided was in the review and re-drafting of the extensive integrated double cell policies required of the Consent Decree and the ending of the “Con-Boss” system of management, for submission to the Courts for approval

Alamanza was attacked and seriously injured. Case on-going.
Retained Expert Witness Southern New Mexico Correctional Facility – Client Eric Chavez – Case Number 2:19-cv-00447-KRS/SMY – violation of the Prson Rape Elimination Act (PREA) case involved a mass unclothed strip search of several inmates which was transmitted via closed video to other parts of the facility including the facility contra center manned by a female corrections officer. Retained Expert Witness 2019 – Atty. Charles Carbon – San Quenhtin Covid-19 wide spread infections – due CDC-R negligence of transfer of 100′ of inmates which bhad nnot been tested for Covid-19 many were contagious and spread the virus to both staff and inmates at the receiving institution in particular San Quentin which is a Reception Center which processes new commitments, or parole violators, case still pending.
Retained Expert Witnewss January 2021 – Atty. Patrick Hurley, Contra Costa Public Defenders Office-Plaintiff Fanaro through his attorney brought a federal civil action against the Contra County Shriff’s jail divisiom alleging the jail failed to protect him as as a result of the jail’s negligence Fanaro was severly beaten requiring outside commuity medical treatment and hospital admission. Fanaro during his booking ptocess into the jail all prisoners are routinely asked about any gang affiliation, fanaro claimed he was a Nothern-Hispanic gang and had been affiliated since the age of 13. The jail operated a special module housing only Northern-Hispanic identified as Northern -Hispanic gang members. Fanaro early into cell assignment declared tomhis ncell mate that he wanted to drop out of the Northern-Hispanic gang. Fanaro was warned and was aware of the consequences of dropping out of thd gang. Inmates are permitted to exercise in an outside yard by tier. When Fanaros tier was allowed to the excersice yard Fanaro was seriously beaten. Due to staff failure to follow jail policy which required the returning of the inmates back to thier cells and accounted for. Fanaro remained on the yard and as a consequence was again severly assaulted. Fanaro required outside community hospita admission and treatment. Identifying his assailents they were charged with felonly assault charges by the Contra Costa DA’s Office the assailants were found Quilty and sentenced to state prison. Federal Rule 26 report was filed. Case is on-going.
